Default Help With Livestream Please! BMI Problem With Framerate.

Okay so here is what i have first:

Justin.tv/JayMinioN
(if you wanna check the recent videos and see what the problem may be)

Black magic intensity pro (already have Latest Drivers up to 8.01)
HDMI in and out to Xbox360/TV

Program For Streaming:
- Flash Media Live Encoder 3.1 (cannot buy wirecast cause im not rich lol)

PROBLEM:
- Okay so everytime i open FME 3.1 my black magic has the default framerate set to 59.96 which is way to high for streaming in HD. anyways when i try and move the framerate from 59.96 down to 29.97 (avg framerate) the FME 3.1 program just pauses for a second then resets the framerate back to 59.96, it continued to do this on any framerate i changed it to, so my BMI wont let me stream in anything but 59.96, someone please help i don know what to do, i have spent hours watching videos and reading forums but found nothing!

Might Fix The Issue; So i have 2 ideas that might work and need suggestions:

+ FIRST: i am going to try and stream with all HD component cables instead of HDMI, that might allow a lower framerate to pass through the cap.
+ SECOND: i might have to try download either FME 2.3 or 3.0 and try streaming with one of them instead of the newer 3.1 verson, this may allow a framerate change.

I AM WILLING TO PAY/DONATE FOR ANYONE WHO CAN HELP ME WITH THIS, I have spent over 200$ for capcard and more for my computer and im willing to throw down like 10$ for someone to help me with this probem PLZZZZZ!!!!

Ditch the BMIP go the fme/vhscrcap route. I did that myself.
